Leave & License Agreement

This Agreement for Leave & License is made and executed on this 20th day of November, 2023 according to English Calendar month.

1. Security Deposit

The Second Party shall keep deposit sum of Rs. 3,000/- (Rupees Three thousand) only at the time of execution of this Agreement, towards Security Money to the First Party which is refundable/adjustable at the time of vacating the schedule property.

2. Use of Property

The License comprises of one self-contained residential unit which shall be used only for residential purpose. The Second Party shall not change the nature and character of the schedule property by way of addition and alteration.

3. Monthly License Fee

The monthly license fee is Rs. 2,900/- (Rupees Two Thousand Nine Hundred) only, payable according to English Calendar month within 5th day of every preceding month.

4. Maintenance and Damage

The Second Party shall keep the demised premises always in habitable condition and shall not damage any portion of the same. If any damage is found, the Second Party shall repair or restore the damage in habitable condition at his own cost. Otherwise, the First Party shall deduct the estimated cost of repairing from the Security Money.

5. Prohibited Activities

• No Cooking: The Second Party shall not be allowed to cook foods inside the demised premises.
• No Sub-letting: The Second Party shall not sub-let or part with possession with any third party stranger.
• No Illegal Activities: The Second Party cannot store any inflammable or combustible articles and cannot do any illegal activities in the said residential premises.
• No Intoxication: The Second Party is strictly prohibited to consume intoxicated materials inside the license premises.

6. Noise and Disturbance

The Licensee shall ensure that the use of the demised premises shall not become a source of disturbance, noise or nuisance to any neighbor.

7. Notice Period

If either party intends to vacate the schedule mentioned premises, each side should inform in writing to the either side party, 01 month before.

8. Vacation and Refund

After expiry of the stipulated period of Agreement, the Second Party shall leave and vacate the schedule property and the First Party shall refund the Security Money (Balance if any) to him without any interest.

9. Required Documents

The Second Party is instructed to submit his Aadhaar Card, Voter ID card and College/University/Institution ID Card to the First Party duly self attested.

10. Legal Disclaimer

This Agreement does not fall under the purview of the West Bengal Tenancy Act.
